Dallas County Regulations
Dallas County has its own regulations concerning claims under the Texas Tort Claims Act:
Sec. 1.03.004 Counsel to Respond to Claims Against Directors, Officers and Employees
The current consulting law firm of the District is hereby appointed to represent and to respond promptly and effectively to any claims against the directors, officers, and employees of the District for actions taken or not taken in the performance of their duties as directors, officers and employees of the District. (Order O-0052, sec. 1 (1.1500), adopted 9/27/11)
Sec. 1.03.005 Committee to Investigate Allegations and/or Complaints
(a) Committee Established. A committee to investigate allegations and/or complaints brought against the District itself or against any employee of the District is hereby established. The committee shall be made up of two (2) board members.
(b) Powers and Duties of Committee. The committee shall have the following powers and perform the following duties:
(1) Make a proper and in-depth investigation on behalf of the entire Board of Directors into any allegations and/or complaint brought against the District or any employee of the District.
(2) Action may only be taken with the approval and consent of both members of the committee.
(3) Report back to the entire Board all findings of fact and/or evidence regarding any allegation and/or complaint.
